to get 1 entry into the draw; Or (b) if you are already a member of the Choice Privileges program, book and complete a stay in Australia or New Zealand via either www.choicehotels.com or the Choice Hotels App, ensuring you provide your membership information at the time of booking to get 1 entry into the draw. Membership of the Choice Privileges program (and, consequently, participation in this competition) is subject to the terms and conditions which apply to the Choice Privileges program available at www.choicehotels.com/en-au/choice-privileges/rules-regulations as amended from time to time. If you are not already a Choice Privileges member, your entry will be only deemed to be received when received by the Choice Privileges database. Once your membership is activated (by receiving a direct email message welcoming you to the program), you will receive 1 entry into the draw. You may then proceed to make a booking (as per step (b) above) if you wish to receive an additional entry into the draw. For clarity, registering to be a Choice Privileges member = 1 entry, and if you also make a booking and complete your stay during the Competition Period, you will receive another entry into the draw = total 2 entries. If you are already a Choice Privileges member, your entry will be deemed to be received at the time you check-in to your stay. If for any reason you are unable to complete your stay, your entry may be deemed invalid at the Promoter's sole discretion (for example, if you cancel your booking). Any additional bookings made and completed before the end of the Competition Period will entitle you to receive an additional entry (e.g. 1 booking/stay = 1 entry, 2 bookings/stays = 2 entries, etc). |
| How many winners will there be and how will they be chosen? | There will be 21 winners determined in respect of this competition – 1 major winner and 20 minor winners. The draw will be held at 2pm (AEDT), which is 4pm (NZDT) on 15/01/2024 at the Promoter's office at Level 26, 2 Southbank Boulevard, South Bank VIC 3006. The first valid entry drawn randomly in the draw from all of the entries received during the Competition Period will win the major prize. The next 20 valid entries randomly drawn will each win a minor prize. The Promoter may draw additional reserve entries in a draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants). |
| What can I win? | There are 21 prizes available – 1 major prize and 20 minor prizes. Major prize The major prize is 1 million Choice Privileges Points valued at AUD$10,300/NZD$11,143.22 which will be credited to the winner's Choice Privileges account. Minor prizes There are 20 minor prizes. Each minor prize is a two-night Choice Hotels accommodation e-Voucher (sent to the winner via email), redeemable for a stay in a standard room at any Choice Hotel across Australia or New Zealand valued at AUD$500/NZD$540.93 (e-Voucher). | How many times can I enter? | You can enter multiple times, provided each entry is submitted separately in accordance with these Terms and Conditions. Additional entries available as set out in the Entry instructions above. |
| How and when will the winner/s be informed? | The winners will be notified by phone and in writing within two business days of determination and their name and state/territory of residence will be published on the Website on 24/01/2024 for a period of 28 days. |
| Unclaimed prize/s | Prize claim date: 5pm (AEDT) being 7pm (NZDT) on 14/02/2024. Unclaimed prize determination: 2pm (AEDT), being 4pm (NZDT) on 15/02/2024 at the same location as the original draw. If a prize has not been accepted or claimed by the prize claim date above or if, after making all reasonable attempts, the Promoter can't contact a winner (or a winner does not contact the Promoter) by the prize claim date above, the relevant entry/ies will be discarded and the Promoter will re-award the relevant prize/s to Reserve Entrant/s and/or carry out an unclaimed prize draw at the date, time and place stated above to randomly distribute the prize/s in descending order of value amongst valid entrants who (if possible) have not already won an unclaimed prize. Any winner/s will be informed by phone and in writing within two business days of determination and their name and state/territory of residence will also be published on the Website on 19/02/2024 for a period of 28 days. | Collection and use of your personal information | If you are a winner, you and your companion agree to take part in, and co-operate as required by the Promoter with respect to, any and all publicity, photography and other promotional activity that the Promoter reasonably requires, without any compensation. You/your companion consent to the Promoter using your name and image in any promotional or advertising activity, and agree to grant the Promoter a perpetual, irrevocable and exclusive license to use any photographs in all media worldwide, including online social networking sites, without compensation to you/your companion. The Promoter and its related entities collect entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners) and for related purposes. Entry into the competition/acceptance of a prize is conditional upon you providing the requested information and by entering this competition and/or accepting a prize you consent to the use of your personal information as described below. By entering, you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging provided that where required by the Spam Act 2003 (Cth), the Promoter includes a functional unsubscribe facility in each direct marketing communication it sends you that you may use to opt-out of any further such communications and provided that the functional unsubscribe facility complies with the Spam Regulations 2021 (Cth). 1. These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions.
Entry
2. Your entry must be received during the Competition Period and will be deemed to be received only when received by the Choice Privileges database. You will receive an electronic direct mail message welcoming you to the Choice Privileges program (if you are signing up to the program for the first time). The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.
Prizes
3. Prizes and all elements of prizes must be taken as specified, as and when offered, and cannot be altered or changed in any way by you or will be forfeited, and if forfeited, the Promoter will not be liable. If you forfeit the prize or any element of the prize for whatever reason, you will not be given cash or any alternative prize as a substitute. Prizes are subject to any additional terms and conditions imposed by the relevant supplier of the prize or the Promoter, including:
- validity period/s;
- booking and availability of accommodation;
- conditions of travel and conditions of entry into any event venues (including behaviour requirements, COVID safety requirements and applicable dress codes);
- travel dates and specified travel exclusion periods;
- any additional fees (payable by you) relating to changes made by you to a booking after it has been booked;
- the requirement to obtain all necessary documents to travel to any overseas location specified, including a current and valid passport and any visas required;
- a requirement to present your credit card when checking in to accommodation; and
- a requirement that any person taking the prize that is aged under 18 years old must be accompanied by their parent or guardian at all times.
4. You/your companion are responsible for all other unspecified costs related to a prize, including meals, transport, insurance (including excesses), in-room charges, additional taxes, etc.
5. The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a prize.
General
6. If you or your entry are deemed by the Promoter to breach these Terms and Conditions, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
7. You must not:
- tamper with the entry process (including but not limited to manipulating the system via bots, script use, or any other means to circumvent the entry process);
- engage in any conduct that may jeopardise the fair and proper conduct of the promotion;
- act in a disruptive, annoying, threatening, abusive or harassing manner;
- do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this promotion, including without limitation during the participation in any prize;
- breach any law; or
- behave in a way that is otherwise inappropriate.
8. You are responsible for your companion and the Promoter may disqualify all entries from, and prohibit further participation in this competition by, you or your companion if they breach these conditions, whether or not legally bound by them.
9. Any failure by the winner or their companion to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn at any time (including for the avoidance of doubt, during the fulfilment of the prize itself) without liability for the Promoter or the prize supplier(s).
10. The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
11. If any dispute arises between you and the Promoter concerning the conduct of this promotion or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time. Despite the aforementioned, the Promoter’s decision in connection with all aspects of this promotion is final.
12. Prizes cannot be transferred or exchanged nor redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. All ancillary costs or requirements associated with a prize are your sole responsibility. The prize value is correct as at the date of preparing these Terms and Conditions and includes any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if the prize (or element of the prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the relevant gaming authorities.
13. By entering, you request that your full address not be published.
14. If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure government directives, a pandemic, public health orders and the like, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities. Where it is practical for it to do so, the Promoter will notify you of such changes.
15. The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. For Australian residents, if for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values. If for GST purposes this competition results in any supply being made for non-monetary consideration, participants must follow the New Zealand Inland Revenue stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.
Liability
16. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth) and the New Zealand Consumer Guarantees Act 1993 (“Non-Excludable Guarantees”).
17. Except for any liability that cannot be excluded be excluded by law (in which case that liability is limited to the greatest extent allowed by law), including liability under the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) and the agencies and companies associated with this competition exclude all liability (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death or any loss, expense or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion and promotion or any prize, including without limitation (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged, or misdirected due to any reason beyond the reasonable control of the Promoter; (d) any variation of the prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) use of a prize by any person.
18. Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of the prize/s.
19. This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
