DC Super-Pets Sign Up and Win Competition Terms and Conditions

Who can enter? 
Australian and New Zealand residents who are aged 18 or over.

Who can't enter?     
Directors, officers, management and employees (and their immediate families) of:
(a)    the Promoter; and
(b)    the agencies, companies or participating premises associated with this competition.

Entry instructions     
To automatically receive one entry, you must, during the Competition Period:
(a)    if you are not a member of the Choice Privileges program, become a Choice Privileges program member by either:
(i)    visiting the Website directly and filling out and submitting the online membership form including providing all requested information; or
(ii)    visiting a Qualifying Choice Hotel in either Australia or New Zealand and signing up as a new Choice Privileges member, ensuring you provide all requested information,
or
(b)    if you are a member of the Choice Privileges program, book and complete a stay in Australia or New Zealand via either ChoiceHotels.com or the Choice Hotels App, ensuring you provide your membership information at the time of booking.
At the end of the Competition Period, entries will be separated into two groups for the purpose of drawing winners, based on country of residence.

Membership in the Choice Privileges program and, consequently, participation in this competition is subject to the terms and conditions which apply to the Choice Privileges program available at www.choicehotels.com/en-au/choice-privileges/rules-regulations, as amended from time to time.  
If you are already a Choice Privileges member, your entry will be deemed to be received at the time you check-in to your stay. If for any reason you are unable to complete your stay, your entry may be deemed invalid at our sole discretion (for example, if you cancel your booking).

How many winners will there be and how will they be chosen? 
There will be 25 winners determined in respect of this competition - 20 winners in respect of entries received from Australian residents and 5 winners in respect of entries received from New Zealand residents. There will be 2 draws conducted -1 for Australian residents and 1 for New Zealand residents. The draws will be held commencing at 2.00pm (AEDT) (which is 7.00pm (NZST)) on 05/10/2022 at 150 Jolimont St, East Melbourne VIC 3002. The first 20 valid entries drawn randomly from the entries received from Australian residents during the Competition Period will each win a prize. The first 5 valid entries drawn randomly from the entries received from New Zealand residents during the Competition Period will each win a prize. The Promoter may draw additional reserve entries in a draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants). 

What can I win? 
There are 25 prizes available - 20 Australian prizes and 5 New Zealand prizes.  
Each prize is valued at AUD156 / NZD173.31 and consists of:

There is a limit of one prize per person (except for South Australian residents).
The total prize pool is AUD3,120 / NZD866.55.

How many times can I enter? 
You can only enter once.  

In Season Pass T&C’s 
One Family Movie Pass (admits four people) to see the “DC League of Super-Pets” movie in your nearest participating cinema. The winners can present the supplied Family Movie pass at participating cinemas to receive four free tickets for a session of the film. For the avoidance of doubt, all four tickets must attend the same session. The pass is valid for “DC League of Super-Pets” only and is valid at participating cinemas only. Valid even with NO FREE TICKET restrictions, but not valid on cinema discount days, Saturdays after 5 pm or Public Holidays. Not valid for resale or with any other offer. Not transferable, exchangeable or redeemable for cash. Not valid for mobile or online ticketing. Seats are subject to availability. Voucher must be surrendered upon redemption. Not valid at a premium, large format screens or special events. Always check the cinema for details and validity. For the avoidance of doubt, the Family Pass prize does not include transport to and from the cinema, or any food and beverages. It is the winner’s responsibility to organise and pay for transport and food and beverages. Cinema entry is always subject to the terms and conditions of the individual cinema location, including without limitation the cinema’s right to remove the winner from the cinema for any inappropriate behaviour. Should this occur, the winner forfeits the prize and no alternative will be provided.

How and when will the winners be informed?    
Winners will be notified by phone and email within two business days of determination. 

Unclaimed prize/s
Prize claim date: 5.00pm (AEDT) (which is 7.00pm (NZDT)) on 12/10/2022. 
Unclaimed prize determination: 2.00pm (AEDT) (which is 4.00pm (NZDT)) on 16/11/2022 at the same location as the original draw. If a prize has not been accepted or claimed by the prize claim date above or if, after making all reasonable attempts, the Promoter can't contact a winner (or a winner does not contact the Promoter) by the prize claim date above, the relevant entry/ies will be discarded and the Promoter will carry out unclaimed prize draw/s (as relevant to the prize) at the date, time and place stated above to randomly distribute the prize/s amongst valid entrants who (if possible) have not already won a prize (except for South Australian residents).  Any winner/s will be informed by phone and email within two business days of determination. If any prize remains un-won at the end of this competition, or if a prize winner cannot be found, that information will be published on the Website on 16/12/2022. 

Collection and use of your personal information  
If you are a winner, you and your companions (if applicable) must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation.  You/your companions consent to the Promoter using your names and images in any promotional or advertising activity. 
The Promoter and its related entities collect entrants and their companions’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners) and for related purposes. Entry into the competition/acceptance of a prize is conditional upon you/your companions providing the requested information and by entering this competition and/or accepting a prize you/your companions consent to the use of your personal information as described below.  By entering, you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging, provided that where required by the Spam Act 2003 (Cth), the Promoter includes a functional unsubscribe facility in each direct marketing communication it sends you that you may use to opt-out of any further such communications and provided that the functional unsubscribe facility complies with the Spam Regulations 2021 (Cth). By entering, you consent to receive email or SMS messages from the Promoter without any functional unsubscribe facility if they relate primarily to the conduct of this competition. The Promoter may disclose personal information to essential service providers who provide services in connection with its products and services. This may include disclosures to organisations outside Australia and New Zealand including in places such as the United States of America.  Entrants/their companions may request access to their personal information by writing to Privacy Officer, Choice Hotels International, Inc. of 6811 E. Entry 
Your entry must be received during the Competition Period and will be deemed to be received only when received by the Promoter.  The Promoter is not liable for any problems with communications networks.  You are responsible for your own costs associated with entering.  If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.  

Prizes
Prizes and all elements of prizes must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. Prizes are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including validity periods and terms of use. The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a prize. The Promoter accepts no responsibility if one or more of the events or activities awarded as part of a prize are abandoned, called off or postponed for any reason.  In that case you/your companion/s forfeit your entitlement to that event/activity. Unless otherwise specified by the Promoter, you will not be given cash or any alternative prize as a substitute for this altered prize element. 

General
If you or your entry are deemed by the Promoter to breach these Terms and Conditions, your entry (or at the Promoter's discretion, all of your entries) may be discarded.  The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment).  Failure by the Promoter to enforce any of its rights at any stage does not waive those rights. 
You must not:
(a)    tamper with the entry process (including but not limited to manipulating the system via bots, script use, or any other means to circumvent the entry process);
(b)    engage in any conduct that may jeopardise the fair and proper conduct of the competition;
(c)    act in a disruptive, annoying, threatening, abusive or harassing manner;
(d)    do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;
(e)    breach any law; or
(f)    behave in a way that is otherwise inappropriate.  

You are responsible for your companions and the Promoter may disqualify all entries from, and prohibit further participation in this competition by, you or any or all of your companions if they breach these conditions, whether or not legally bound by them. The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted. If any dispute arises between you and the Promoter concerning the conduct of this competition or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time.  In all other respects, the Promoter’s decision in connection with all aspects of this competition is final. Prizes cannot be transferred or exchanged nor redeemed for cash.  Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement.  The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST.  The Promoter is not responsible for any change in prize value. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the relevant authorities.  If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the relevant authorities.  The Promoter is not responsible for any tax implications arising from you winning a prize.  You should seek independent financial advice.  For Australian residents, if for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

Liability
Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth) and New Zealand Consumer Guarantees Act 1993. Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law). Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant).  Unless otherwise specified, prize/s will only be delivered  digitally. This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter.  You provide your information to the Promoter and not to any social media platform.  You completely release any relevant social media platforms from any and all liability.
