General Program Information

Choice Hotels International, Inc. is the owner and operator of the Choice Privileges® Rewards Program (the “Program”). As used in these Rules and Regulations (the “Rules”), the term “Choice” references Choice Hotels International, Inc. and its subsidiaries and corporate affiliates. For Canadian residents, the Program is owned by Choice Hotels Canada, Inc. and administered by Choice.

Choice provides these Rules for the Program. These Rules apply to members in both the United States and internationally, but certain Rules sections (such as the sections on the Choice Privileges Mastercard, which are only applicable to U.S. Program Members) and Program benefits and other features vary by country, as specified herein.

The effective date of these updated Rules is January 1st, 2026. The following sets the rules of the Program and supersedes any previous Rules. Your participation in the Program is governed by these Rules, and you should read and understand them.

Choice may add, change, or delete any Program term, condition, rule, or regulation, in its sole discretion, with or without notice, and may terminate the Program at any time without notice.

THESE RULES INCLUDE AN ARBITRATION AGREEMENT. IF THERE IS A DISPUTE BETWEEN YOU AND US, AND THE DISPUTE IS COVERED BY THE ARBITRATION AGREEMENT, THEN YOU OR WE MAY REQUIRE THE CLAIM TO BE RESOLVED BY ARBITRATION. THIS MEANS THAT: (1) THE CLAIM WOULD BE DECIDED BY AN ARBITRATOR AND NOT A COURT; (2) YOU AND WE WILL NOT HAVE THE RIGHT TO A JURY OR COURT TRIAL TO RESOLVE THE CLAIM; AND (3) YOU AND WE WILL NOT HAVE THE RIGHT TO PURSUE A CLAIM AS A CLASS ACTION. YOU HAVE THE RIGHT TO REJECT ARBITRATION AS EXPLAINED IN THAT SECTION.

Joining Choice Privileges

To become a Program Member (a “Member”), you must be an individual who is 18 years of age or older, or the age of majority in your jurisdiction. Membership is not available to corporations or other entities. You may establish and maintain only one Member Account. Choice will terminate any additional Accounts at its sole discretion and will not transfer or reimburse you for any points in additional Accounts.

To become a Member you must submit a Member Application (“enroll”). Member Applications may be submitted from various authorized sources, including but not limited to the Member Application form on ChoiceHotels.com, via the Program’s toll-free express reservation line (“Program Line”), or directly with a hotel. If Choice approves your Member Application, you will be provided a Member Number. When you receive your Member Number, you are a Program Member and Choice will inform you when you are eligible to receive Hotel Benefits and earn Choice Privileges points. Choice will not apply Choice Privileges points to your Member Account, nor provide you with Hotel Benefits, before approving your Member Application and activating your Member Number.

You must maintain an address in the U.S. (including U.S. territories), Canada, Europe (including British Virgin Islands, French Guiana, Guadeloupe, Martinique, Saint Barthelemy and Saint Martin), or countries in the Middle East, Africa, Mexico, Latin America, the Caribbean, or Asia-Pac (including Australia, New Zealand, Singapore, Thailand, Papua New Guinea and Fiji) or otherwise specified country where Program membership is available. If your country is not listed as an option on the Member Application, membership has not been opened in your area yet.

Membership is not allowed for any person with a residence in country subject to U.S. sanctions. Membership also is not currently allowed for any person listed on the U.S. Department of Treasury’s Specially Designated Nationals and Blocked Persons List or otherwise subject to U.S. economic sanctions. If you change your address to outside the U.S., it may limit our ability to mail certain items or communications to you.

Earning Choice Privileges Points

Participating Locations

While most stays at Choice hotels earn Choice Privileges points, most Choice hotels are independently owned and operated and certain brands, locations, or third-party non-Choice-franchised hotels that are available to book through Choice may not participate in the Program.

You can earn Choice Privileges points for any points-eligible stay, as discussed below, at any participating Cambria®, Clarion®, Clarion Pointe®, Comfort®, Econo Lodge®, Everhome®, MainStay Suites®, Quality®, Rodeway Inn®, Sleep Inn®, Suburban Studios®, and Ascend CollectionTM location, in the U.S., Canada, Europe (excluding Denmark, Estonia, Finland, Iceland, Latvia, Lithuania, Norway and Sweden), the Middle East, Mexico, Brazil, Ecuador, Colombia, Guyana, Central America, the Caribbean, and Asia-Pacific region, including China, Japan, Thailand, Malaysia and India. You can also earn points at Radisson Individuals®, Radisson Collection®, Radisson Blu®, Radisson®, Radisson RED®, Park Plaza®, Park Inn by Radisson®, and Country Inn & Suites® by Radisson, in the U.S., Canada, Latin America, and the Caribbean (collectively with the foregoing sentence, “Participating Locations”). Radisson hotels located outside these areas are owned by the Radisson Hotel Group, an unaffiliated company headquartered in Belgium, and they do not participate in Choice’s Program.

WoodSpring Suites® locations do not participate in the Program. [You can’t earn or redeem points at WoodSpring Suites locations, nor are other Program benefits available at those locations.]

Earning Points on Stays

Point Eligibility

The most common way to earn Choice Privileges points is by completing a “Points-Eligible Stay” on a points-eligible rate plan at a participating Choice/Program location. Unless specified otherwise (in the terms of a specific promotion or other Choice communication), reservations must be made through Choice channels to qualify for Choice Privileges points. As a Member, you may make points-eligible reservations through the Program's toll-free express reservation line, the Program website (ChoiceHotels.com), our mobile app, or directly with a participating hotel.

Points-Eligible Stay spend includes each whole U.S. dollar that you pay in full in room rate for a Points-Eligible Stay, excluding taxes and other incidental charges.

Points-Eligible Stay spend also includes each whole U.S. dollar that you pay in full for food and beverage purchases made at participating Radisson Individuals®, Radisson Collection®, Radisson Blu®, Radisson, Radisson RED®, and Park Plaza® locations in the Americas. [The Radisson locations outside the Americas do not participate in the Program.] Food and beverage earn may exclude tax, tip, and charges for alcoholic beverages or other items where prohibited by law. There is no earn for food and beverage charges incurred at outlets that are not managed or owned by the hotel. Food and beverage charges must be posted to the guest’s folio (i.e., guest bill) to be considered Points-Eligible Stay spend.

Points-Eligible Stays: Most stays at Participating Locations are eligible to earn Choice Privileges points (i.e., are considered points-eligible) EXCEPT: rooms booked using an ineligible rate plan (as discussed below), rooms booked at rates below $40 USD per night, certain hotel initiated promotions, reward night stays, complimentary rooms, Points Plus Cash reservations (as discussed below), rooms paid for as part of a convention or meeting, rooms booked through a travel agent or third party online retailer including online travel agencies (unless otherwise expressly noted), wholesale packages, group tours, and stays booked using the employee discount or the friends & family discount.

Rooms booked through third-party online retailers such as Expedia.com, Orbitz.com, Travelocity.com, Booking.com, Priceline.com, etc., are also not points-eligible.

In the U.S. and Canada, the following rate plans are points-eligible: Best Available Rate, Advance Purchase, Corporate, VIP and Net Preferred, Choice Cares, Government/Military, Travelers' Discount, AAA/CAA, PSCIEN, Package Rates, Small Organization Savings/Significant Savings, Senior Rate, Sports Rate, CPSA, Preferred Customer Savings Rate, Savings at Work, SGRP1, SGRP2, negotiated rates (N) and select LSRPs. The list of points-eligible rate plans is subject to change.

In addition to the rates outlined above for the U.S. and Canada, Choice Privileges points can be earned for the following rate plans internationally: Best Available Rate, Advance Purchase (LEARLI, LADV, SAPR), Negotiated Rates (N), Standard Corporate, Standard Government / Military, Standard Preferred Corporate, Standard Net Preferred, Automobile Association Rates, and Standard Senior Concessions. Point eligibility of Package Rates (P) differs from region to region and must be confirmed locally. The list of points-eligible rate plans is subject to change.

Stays: A "stay" is defined as any number of consecutive nights at one hotel, regardless of check-ins or check-outs. Example: If you check-in at a hotel on a Monday afternoon, check-out of that hotel on Wednesday morning, and then check-back into the same hotel on Wednesday afternoon, and check-out again on Friday morning; those four nights are considered a single (one) stay.

Earn Rate

Members earn ten (10) stay base points for each whole U.S. dollar that is incurred and paid for by the Member of Points-Eligible Stay spend, except at Everhome Suites, MainStay Suites, Suburban Studios location, where earn is calculated differently (and WoodSpring Suites locations, which do not participate in the Program and there is no earn). For example, if a member has a Point-Eligible Stay spend of $121.98 at a participating Cambria hotel, the member will be awarded 1,210 points.

Extended Stay Earn Rate

Stays at Everhome Suites, MainStay Suites, and Suburban Studios earn points at rates that are based on the length of stay and the dollar amount spent.

For Points-Eligible Stays of six (6) nights or fewer, stays at these brands earn ten (10) stay base points for each whole U.S. dollar that is incurred and paid for by the Member of Points-Eligible Stay spend.

For Points-Eligible Stays of seven (7) nights to thirty (30) nights, stays at these brands earn five (5) stay base points for each whole U.S. dollar that is incurred and paid for by the Member of Points-Eligible Stay spend.

Point earning at these brands is capped at thirty (30) nights, and no points are earned for nights thirty-one (31) and after.

All stays at WoodSpring Suites are ineligible to earn points.

Points Posting Time

While points may be posted quickly, allow up to three (3) weeks after checking out from your stay for points to post to your account.

Limits on Number of Rooms

You may earn stay base points for up to four (4) rooms per night at the same hotel. To qualify for points, the rooms must be in your name and the reservations must include your Member Number. Additionally, you must stay in one of the rooms and the rooms must be paid for in full. You only receive any applicable bonus points (for promotions or other bonuses) on one (1) room and, if you are an Elite Member, you only earn Elite status bonus points on one (1) room per stay.

Company Billing

If your individual hotel bill is billed directly to a company and you are responsible for authorization of settlement at check-out, your stay is still eligible for Choice Privileges points as long as your stay otherwise qualifies for points. However, stays where the hotel bill is part of group master-billing arrangement where charges for multiple rooms are placed on one hotel bill and billed to a company or common address or settled at check-out by one individual, are not eligible.

Buying Choice Privileges Points

You may purchase Choice Privileges points via our online storefront and through our call center. You may purchase up to a maximum of 180,000 points per calendar year (unless otherwise allowed and specified by a Choice promotion). There may be minimum purchase requirements, and purchases may be limited to certain increments (such as increments of 1,000 points). Purchased points typically post within twenty-four (24) hours.

When points are purchased to “gift” to another member’s account, the account can receive no more than 180,000 purchased or gifted points per calendar year. If you are gifting points, both your account and the recipient’s account must be open and in good standing with the Program at the time of purchase.

You must be logged into your online account to purchase points. Point purchases are only valid in those countries where the Program is available.

All purchases are non-refundable.

Prices are in U.S. dollars, unless otherwise specified. Please consult your credit card company for any additional foreign transaction fees if outside the U.S.

Redeeming Choice Privileges Points

Reward Nights

You may redeem your accumulated points for a Reward Night at any Participating Location. Members are responsible for any incidental charges as well as any resort or other mandatory fees that are imposed by the hotel. You do not earn points for Reward Night stays or for any incidental charges or fees, though you do earn Elite Qualifying Nights and Milestone Qualifying Nights for these stays.

Points Required

Reward Nights are available at Participating Locations worldwide starting at 6,000 Choice Privileges points per night; most Reward Nights redemption levels start at 8,000 points or more per night. Choice may change Reward Night pricing levels at any time without notice; redemption point levels typically vary by location, brand, and time of year. You may find the required point level for any Participating Location at ChoiceHotels.com or by calling the Reservation Program Line. Reward Nights are not available at WoodSpring Suites and may not be available at other properties.

Booking a Reward Night

Members must make their Reward Night reservation through their online account or through the Program Line no more than fifty (50) weeks prior to the planned conclusion of their stay for all Participating Locations worldwide. Reward Night stays may not be reserved through a travel agent and are not commissionable to travel agents.

Upon Reward Night check-in, you may be asked to show valid government identification.

The hotel will hold your Reward Night reservation until 7:00 AM on the day after your scheduled arrival (and normal hotel check-out times still apply).

A Member may redeem a Reward Night for immediate family members (spouse, partner, children, parents, in-laws, brothers, and sisters) only. Immediate family members can use the Reward Night even if the Member is not occupying the room.

When booking a Reward Night for someone other than yourself, be sure to ask the reservation agent to include the name of the guest in the notes field of the reservation. When booking a reward night through your online profile, be sure to include the name of the guest who will be staying in the room in the “Special Request” field.

Canceling a Reward Night

Members may cancel their reservations through the Program Line or through their online account by the date and time specified by the reservation sales representative or online. If you are unable to use your room and fail to cancel your reservation by the cancellation deadline set by the hotel, or if you do not claim the room by the specified time, Choice will not credit your account with the points that you redeemed for that room.

No Blackout Dates

Reward Nights are available at Participating Locations every night of the calendar year, based on the hotel’s available inventory. Available inventory varies by hotel, brand, time of year, and other factors.

Premium Room Redemptions

Some room types at Participating Locations may not be available for Reward Nights, and some room types may require additional points to redeem (such as premium suites or rooms with multiple bedrooms).

RewardSaver

At times, Choice may offer Reward Nights at a reduced redemption amount through its RewardSaver program. RewardSaver nights start at 6,000 points per night and follow the same rules as typical Reward Nights.

Points Plus Cash

Choice administers the Points Plus Cash program to provide an option to Members who do not have enough points to be able to redeem for the full points cost of a desired Reward Night booking. Points Plus Cash provides an option to purchase the difference in cost of a Reward Night reservation minus 6,000 Choice Privileges points (per night). The “cash” portion of “Points Plus Cash” refers to the price of the remaining points needed for the Reward Night reservation. For example, if a Reward Night reservation for one-night costs 20,000 points and the Member has 6,000 points, the Member can purchase the remaining 14,000 points through Points Plus Cash, if available, and immediately redeem the points for the Reward Night reservation.

Points Plus Cash is valid only for U.S. Members at Participating Locations and Members do not earn points on Points Plus Cash stays. The cash portion of Points Plus Cash reward nights are shown in U.S. dollars. Total cost of points will be shown during the booking process prior to purchase. A valid credit card is required and will be charged immediately to complete the point purchase transaction.

To use Points Plus Cash, a Member must have at least 6,000 points in their account and use at least 6,000 points per night on the reservation.

Points Plus Cash Reward Nights cannot be combined with any other discount or offer. Point requirements may vary based on time of year and other factors. Visit ChoiceHotels.com for details and redemption level information.

A maximum of 250,000 points can be purchased in a calendar year through Points Plus Cash (unless a Choice promotion clearly states otherwise). Maximum point purchase levels are subject to change.

Unless otherwise specified, Points Plus Cash-sourced Reward Nights are treated the same as any other Reward Night reservation.

Preferred Hotels & Resorts

Choice Privileges partners with Preferred Hotels & Resorts (“Preferred Hotels”), which is an independent hotel brand representing luxury properties around the world, and which offers Members the ability to redeem points for stays at these hotels. Members may redeem points for Reward Night stays at participating Preferred Hotels & Resorts at set point redemption rates via a booking link provided on ChoiceHotels.com or mobile app. Reservations may not be made directly with Preferred Hotels & Resorts or by calling the hotel reservation center. You must have the correct number of points available in your Choice Privileges account at the time of booking (Points Plus Cash is not available for these bookings) and be signed into your Choice Privileges account to make a Reward Night stay reservation at Preferred Hotels via the booking link provided.

Reward Night reservations with Preferred Hotels cannot be modified.  If you want to change or extend your stay using your points, you must cancel your reservation by using the cancellation link provided on your reservation confirmation email and then rebook your stay through the booking link provided on ChoiceHotels.com. You cannot extend your redemption stay using points by calling the hotel directly or altering the reservation during your stay at the hotel. All reservations utilizing points for a Reward Night redemption must be made through the booking link provided on Choicehotels.com.

The cancellation policy of the selected hotel applies to the Choice Privileges Reward Night and supersedes Choice Privileges Program rules. If you cancel your reservation in accordance with the hotel’s cancellation policy stated on your reservation confirmation, all points used for the reward night will be re-deposited into your Choice Privileges account after seventy-two (72) hours. If you are unable to use your room and fail to cancel by the time noted on your confirmation, your Choice Privileges account will not be credited with the points that you redeemed.  To cancel your reservation, you must use the cancellation link provided in your confirmation email from Preferred Hotels & Resorts.

This redemption option is valid for all Members globally.

Reward Nights at Preferred Hotels are based on single/double occupancy. Additional person charges may apply. Point requirements for some hotels may vary based on time of year or for other factors. Choice may change the point requirements of any hotel, at any time, without notice. You do not earn points when staying at Preferred Hotels & Resorts properties.

Choice Privileges points only guarantee the Preferred Hotels Reward Night room fee. The hotel will collect a credit card at check-in, and any resort fees, incidental fees, food and beverage costs or room deposits are the sole responsibility of the guest travelling and must be paid at check-out. Taxes are included in the points redemption, and you will not be charged additional taxes on your room rate.

Gift Card Redemptions

Choice Privileges Members in the U.S., Canada, and select countries within Europe, the Middle East, Africa, and the Asia-Pacific may redeem points for gift cards (“Gift Cards”) at popular restaurants and retailers. Gift Cards are subject to card issuer terms and conditions; consult with the issuer for details.

If you choose to redeem points for a digital Gift Card, you should receive it at the email address on your Member Account, usually within minutes of the redemption. If you choose a physical Gift Card, Choice will mail your Gift Card by postal mail; please allow 2-4 weeks from your request for delivery.

For security purposes, Gift Cards cannot be shipped to a P.O. Box or non-U.S. address. Members are required to update the address in their online account, if necessary, before completing a Gift Card redemption. Any change to your email and/or mailing address will result in your account being temporarily prohibited from Gift Card redemption for security purposes.

Choice will not reissue Gift Cards, even if lost or stolen. Gift Card redemptions cannot be cancelled after being placed.

  1. Only one (1) Gift Card vendor (issuer) can be redeemed during each transaction.
  2. Only one (1) Gift Card redemption transaction every 48 hours (regardless of plastic or digital).
  3. Plastic Gift Card Redemption Limit: one (1) to four (4) cards with the same denomination from the same vendor.
  4. Digital Gift Card Redemption Limit: one (1) to two (2) cards with the same denomination from the same vendor.
  5. A Member must wait forty-eight (48) hours after an email change before redeeming a Gift Card.
  6. Any transactions that fall outside of these rules will be blocked.

Gift Card selection is subject to change. Gift Card redemption rules, including the number and dollar value of redemptions and other Gift Card rules, are also subject to change at any time, with or without notice.

Airline Rewards Redemptions

You may redeem your Choice Privileges points for airline miles or airline points (collectively, “airline miles”) with participating eligible loyalty programs via Choice’s Rewards Exchange online portal.

Airline partners and exchange ratios are subject to change at any time. To earn airline miles, you must be a member of a participating airline or other loyalty program and abide by that program's rules and regulations to exchange Choice Privileges points for airline or other loyalty program rewards. Choice Privileges Members may exchange a maximum of 1 million points in a calendar year. When redeeming Choice Privileges points online for airline miles and other loyalty program rewards, Members will be using the Choice Privileges Rewards Exchange program, powered by Points.com.

By using the Choice Privileges Rewards Exchange program, and completing any transaction, Members acknowledge and agree to the Points.com Terms of Use and Privacy Policy.

When using the Choice Privileges Rewards Exchange program, Members may redeem Choice Privileges points for airline miles or points/rewards in other participating eligible loyalty programs. Exchange ratios are published in the Rewards Exchange online portal. Ratios can change from time to time and, unless otherwise specified, Members must redeem a minimum of 5,000 Choice Privileges Points when exchanging for airline miles or points/rewards in other participating eligible loyalty programs. Airline Rewards cannot be exchanged for Choice Privileges points.

When you use the Rewards Exchange program, your points or miles will generally post to your account within seventy-two (72) hours. In some cases, airlines will credit your account on a weekly basis, and it may take up to seven (7) days for your rewards to be deposited into your account. You are solely responsible for checking the airline partner’s account to verify that such loyalty currency has been properly posted. If you believe that the loyalty currency of the eligible airline program has not been properly posted to your account with the airline partner, you must inform Choice Privileges within six (6) months of the date of the exchange transaction, with proof of action acceptable to Choice Privileges and Points.com. You agree that Choice Privileges and Points.com shall determine, in their sole discretion, whether loyalty currency of the eligible airline program should have been posted to your account with the airline pursuant to an exchange transaction, and that any such determination shall be final and binding.

The exchange offer may be canceled, changed, or withdrawn at any time, even after acceptance by you.

Charitable Donations

You may redeem your points for specific donations from a select list of eligible charity partners. To redeem points for a charitable donation, sign in to your Choice Privileges account at ChoiceHotels.com. Redemptions will be made to each charity on a semi-annual basis, or more frequently. The donation will be reflected on your online statement, which will constitute your receipt.

Please consult your tax advisor regarding whether your donation of points may be tax deductible.

AARP Membership

Choice Privileges Members residing in the U.S. may request redemption of their points for an AARP Membership.

Choice will provide AARP with your membership request for processing. Please allow 4-8 weeks for your AARP membership to be processed.

Choice is not responsible for denied AARP memberships for Choice Privileges Members not meeting the AARP membership requirements and will not reinstate any Choice Privileges points redeemed.

Point Expiration

Members must remain active in the Program to retain the points they accumulate and to use other Program benefits. If a Member is not active for eighteen (18) consecutive calendar months, that Member forfeits all accumulated points and their account becomes inactive.

To stay active, a Member must complete a Qualifying Activity (see below), the completion of which extends the expiration date of points by eighteen (18) additional calendar months, beginning with the first month in which the activity is completed through the eighteenth (18th) month of inactivity.

A “Qualifying Activity” is completed when a Member earns or redeems points. Qualifying Activities include, but are not limited to, completing a qualified Points-Eligible stay, redeeming Choice Privileges points, earning points with one of our partner programs, or purchasing Choice Privileges points.

Not all activities are “Qualifying” and count toward maintaining an active status in the Program. The following are some examples of non-qualifying activities that do not count toward maintaining an active status in the Program: completing a non-Points-Eligible Stay (such as a Reward Night stay or other stay that does not qualify to earn points) or registering for a promotion.

Points Never Expire for Current Elite Members

Choice Privileges Elite Members (Members who currently hold Gold, Platinum, Diamond, or Titanium Status) are exempt from point expiration during the periods in which they hold Elite Status and are in good standing with the Program.

If a Member loses all Elite Status and becomes a non-Elite Member (a Member who does not hold Gold, Platinum, Diamond, or Titanium Status), their point expiration date will be set as eighteen (18) calendar months after the day in which their Elite status was lost.

Points Reinstatement

Members whose points have expired may complete a Points Reinstatement Transaction to apply to have some or all of their expired points reinstated.

Points reinstatement is only available for up to one hundred eighty (180) days following the date of point expiration. Members must verify their account by providing their login credentials when prompted during the reinstatement process.  Members may access the reinstatement process by visiting their Member account page on ChoiceHotels.com or through the email communications that are sent to Member.

All Points Reinstatement Transactions are non-refundable, unless otherwise required by law.

If the reinstatement request is approved, points are typically deposited into the receiving account within seventy-two (72) hours after submission of the request.  Choice, however, makes no representation that points will be delivered to the receiving account in any particular amount of time and is not responsible or liable for any delays associated with the completion of reinstatement.

Prices for reinstated points do not include any fees or taxes and are subject to change without notice. GST/HST is charged to Canadian residents. The total purchase price, including any applicable fees and taxes, charged in connection with a Points Reinstatement Transaction will be shown during the check-out process.

Any points subject to a Points Reinstatement Transaction do not count towards qualifying for any increased or improved status in the Choice Privileges program.

Points Reinstatement Transactions are subject to the transaction limit set forth below: Members can reinstate their inactive account and some or all (up to the limits below) of their expired points, up to one hundred eighty (180) days after expiration. A reinstated account will be active, without any other Member action, for eighteen (18) months from the day of points reinstatement. If there is no other Qualifying Activity by the Member during that time, the account will go inactive again at that time and any points in the account will again expire. You can reinstate a maximum of 1,000,000 points. Members may only submit one (1) request to reinstate points per month, which they can make up to one hundred eighty (180) days after expiration, up to limit of the total points expired (and subject to the 1,000,000 points cap).

You agree to make full payment to Points.com with a valid payment instrument prior to any points being posted to your account. By submitting a request for a Points Reinstatement Transaction, you authorize Points.com or its representative to charge the credit card number you provided.

Choice Privileges Elite Membership

The Program offers four Elite Membership levels that provide additional benefits over standard Program Membership. These Elite Membership levels are (in order) Gold, Platinum, Diamond, and Titanium. Elite Membership levels (also called Elite Statuses) are subject to change at any time, with or without notice, as are the benefits associated with them.

Earning Elite Status

Elite Status is granted to a member based on the number of Elite Qualifying Nights (EQNs) or Elite Qualifying Credits (EQCs) a Member has earned within a calendar year.

Elite Qualifying Nights (EQNs) are the sum of a Member’s Points-Eligible nights and nights under the Employee or Friends & Family rate plans within the calendar year. The Program may also award additional EQNs to a Member as part of specific promotions or rewards.

Elite Members only earn EQNs on one room per stay. A “stay” is any number of consecutive nights at one hotel regardless of check-ins or check-outs.

Elite Qualifying Credits (EQCs) are the sum of a Member’s Stay Base Points earned from Points-Eligible Stays within a calendar year. Not all points earned count toward EQCs. Elite Stay Bonus Points (such as the 10%, 25%, or 50% bonus points an Elite Member earns on a Points-Eligible Stay) do not count toward EQCs. Additionally, no EQCs are earned (unless otherwise specified) for bonus points earned through national promotions, or for points earned for a Milestone Reward when the points option is selected, or for the additional points awarded for Point Accelerator Packages (besides the EQCs earned for the Stay Base Points earned for that stay), or for points on bookings for Choice Privileges Cruises.

By accumulating enough EQNs or EQCs, a Member can earn Elite Status. Elite Status is given after the Member meets either the required number of EQNs or EQCs to earn that status level. A Member cannot combine any number of EQNs and EQCs to achieve a status (for example 2 EQNs plus 6,000 EQCs to achieve Gold status) – they must meet either the EQN or EQC threshold.

Below are the current EQN and EQC thresholds necessary to achieve Elite status:

GoldPlatinumDiamondTitanium
5 EQNs or
10,000 EQCs
15 EQNs or
30,000 EQCs
35 EQNs or
70,000 EQCs
55 EQNs or
110,000 EQCs

[Thresholds are subject to change.]

Elite Status Terms Applicable to US Members who Have a Choice Privileges Mastercard (Only)

The Choice Privileges Mastercard is available through a U.S. financial institution and is subject to its own eligibility requirements, which Choice not control. Unless otherwise specified, the Choice Privileges Mastercard is only available to with a U.S. Choice Privileges account.

U.S. Program Members who have a Choice Privileges Mastercard linked to their Program account have two accelerated paths to earning Elite Status. First, Members who are cardholders may be awarded bonus EQNs as specified in their applicable Choice Privileges Mastercard Terms and Conditions. Second, in addition to earning Elite Status based on the number of EQCs a Member has earned from Stay Base Points earned from Points-Eligible Stays, Members also earn EQCs equal to the number of points earned on qualifying card spend within a calendar year.

Note that unless otherwise specified, limited-time cardholder offers (such as any sign-on bonuses), and cardholder anniversary bonuses also do not count toward EQCs. Unless otherwise specified, the only way to earn EQCs is through completing Points-Eligible Stays or completing qualified spend on a Choice Privileges Mastercard.

Earning Elite Progress at Extended Stay Brands

Stays at Everhome Suites, MainStay Suites, and Suburban Studios earn Elite Qualifying Nights and Elite Qualifying Credits at rates that are based on the length of stay. [Stays at WoodSpring Suites do not earn EQNs or EQCs.]

Stays that would qualify to earn EQNs at other Choice brands also earn EQNs at these brands (including Points-Eligible stays, Reward Nights, Points Plus Cash, Employee or Friends & Family stays), at the following rates:

For stays of six (6) nights or fewer, stays at these brands earn one (1) EQN for every night completed.

For stays of seven (7) nights or more, stays at these brands earn one (1) EQN for every two full nights completed.

EQN earning at these brands is capped at fifteen (15) EQNs per stay, as no EQNs are earned after the first 30 nights of the stay.

The rate at which EQCs are earned at these brands is equal to the rate at which points are earned (see “Earning Points”) for all lengths of stay.

For Points-Eligible stays of six (6) nights or fewer, stays at these brands earn ten (10) EQCs for each whole U.S. dollar that is incurred and paid for by the Member of Points-Eligible Stay spend.

For Points-Eligible stays of seven (7) nights or more, stays at these brands earn five (5) EQCs for each whole U.S. dollar that is incurred and paid for by the Member of Points-Eligible Stay spend.

EQC earning at these brands is capped at thirty (30) nights, and no EQCs are earned for nights thirty-one (31) plus.

Maintaining Elite Status

You must qualify for Elite level status each calendar year by achieving either the required number of EQNs or EQCs needed for your status, or as otherwise specified.

Any fraudulent enrollments or abuse of Program benefits may result in the suspension or termination of the Member’s Choice Privileges account, voidance or expiration of any awarded points, and/or the rescindment of any rewards night(s).

Status Soft Landing

If you do not qualify for the status you have by the end of the calendar year your Elite status expires, your status will be downgraded to the next lower tier as part of a process called “Status Soft Landing.” For example, if a Titanium Member does not achieve the 55 EQNs necessary to requalify for Titanium by the end of the calendar year, then on January 1st of the following year, the Member’s Elite status will be downgraded one tier to Diamond, even if the Member would not otherwise qualify for Diamond. Similarly, if the same Member does not requalify for Diamond (or achieve Titanium status) by the end of that calendar year, their status will then fall to Platinum on January 1st of the following year, and likewise until (assuming the Member does not otherwise re-qualify), the Member’s status falls from Gold to non-Elite.

Choice Privileges Member Benefits

Member Discount and Rates

Members will be offered a Member Discount on posted room rates at Participating Locations when they book direct at ChoiceHotels.com, the Choice mobile app, or via the Program Reservation Line. Members receive a discount of 2 – 7% off from participating US hotels published best available rate (“BAR”), advance purchase rate (“APR”) or hotel promotional rate. This Member discount rate varies by region/country.

The BAR is available at Participating Locations. The BAR is available at most U.S. Choice locations and international locations, but not at WoodSpring Suites® locations. The actual BAR varies depending on hotel and time of purchase, is unrestricted, non-qualified, and excludes any other discount rates.

APR reservations must be made at least 7, 14, 21 or 30 days in advance, depending on the hotel. Hotel promotional rates typically require a minimum length of stay. Early departure fees, deposit and cancellation restrictions may apply.

Unless otherwise stated, quoted rates are per room per night, based on single/double occupancy and do not include taxes, gratuities, or incidental charges. BAR, APR and promotional rates may not be combined with other promotions, offers or discounts (unless otherwise allowed and specified by a Choice promotion), and are not valid for existing reservations or for groups. Rates are not transferrable or redeemable for cash and cannot be applied toward a future stay.

Return and Earn Bonus

Each calendar year, all Choice Privileges Members regardless of status will receive 1,000 points as a bonus upon their completion of two (2) separate Points-Eligible Stays, and another 1,000 points as a bonus upon completion of a third Points-Eligible Stay. [Elite status bonuses do not apply to the bonus amounts.] This offer is available to all Members worldwide. This offer resets on January 1st of each year, and any progress (such as having completed only one Points-Eligible stay) is reset. Typical point posting timelines apply.

Milestone Rewards

The Program offers a Milestone Rewards program, where upon completing certain “milestones” throughout the calendar year, a Member earns a personalized reward, as shown below. For some Members or for some regions, these options may be reduced or expanded. Choice may change the Qualifying Criteria and the options or values of these rewards at any time without notice.

Earning Milestone Rewards

Milestone Rewards are granted to a Member based on the number of Milestone Qualifying Nights (MQNs) or Milestone Qualifying Credits (MQCs) a Member has earned within a calendar year.

MQNs are the sum of a Member’s Points-Eligible nights, Reward Nights, and nights under the Employee or Friends and Family rate plans within the calendar year. The Program may also award additional MQNs to a Member as part of specific promotions or rewards.

Members only earn MQNs on one room per stay. A “stay” is any number of consecutive nights at one hotel regardless of check-ins or check-outs.

By accumulating enough MQNs, a Member can earn up to seven (7) Milestone Rewards in a calendar year. A Milestone Reward is rewarded after the Member meets the required number of MQNs to earn that milestone.

Milestone Qualifying Credits (MQCs) are the sum of a Member’s Stay Base Points earned from Points-Eligible Stays within a calendar year.

Not all points earned, however, count toward MQCs. Elite Stay Bonus Points (such as the 10%, 25%, or 50% bonus points an Elite Member earns on a Points-Eligible Stay) do not count toward MQCs. Promotional offers through national promotions and cardholder anniversary bonuses do not count toward MQCs. Additionally, no MQCs are earned alongside any Milestone Reward when the points option is selected. No MQCs are awarded for the additional points awarded for Point Accelerator Packages (besides the MQCs earned for the Stay Base Points earned for that stay), or for points on bookings for Choice Privileges Cruises. Unless otherwise specified, the only way to earn MQCs is through completing Points-Eligible Stays.

By accumulating enough MQNs or MQCs, a Member can earn up to seven (7) Milestone Rewards in a calendar year. A Milestone Reward is rewarded after the Member meets either the required number of MQNs or MQCs to earn that milestone. A Member cannot combine a number of MQNs and MQCs to achieve a status – they must meet either the MQN or MQC threshold.

Below are the current MQN and MQC thresholds necessary to achieve Milestone Rewards:

Earning Milestone Progress at Extended Stay Brands

Stays at Everhome Suites, MainStay Suites, and Suburban Studios earn MQNs and MQCs that are based on the length of stay. [WoodSpring Suites locations do not participate and stays do not earn MQNs.] Stays that would qualify to earn MQNs at other brands (including Points-Eligible stays, Reward Nights, Points Plus Cash, Employee and Friends and Family stays) also earn MQNs at these brands.

For stays of six (6) nights or fewer, stays at these brands earn one (1) MQN for every night completed.

For stays of seven (7) nights or more, stays at these brands earn one (1) MQN for every two nights completed.

MQN earnings at these brands are capped at fifteen (15) MQNs per stay, as no MQNs are earned after the first thirty (30) nights of the stay.

The rate at which MQCs are earned at these brands is equal to the rate at which points are earned (see “Earning Points”) for all lengths of stay.

For Points-Eligible stays of six (6) nights or fewer, stays at these brands earn ten (10) MQCs for each whole U.S. dollar that is incurred and paid for by the Member of Points-Eligible Stay spend.

For Points-Eligible stays of seven (7) nights or more, stays at these brands earn five (5) MQCs for each whole U.S. dollar that is incurred and paid for by the Member of Points-Eligible Stay spend.

MQC earning at these brands is capped at thirty (30) nights, and no MQCs are earned for nights thirty-one (31) plus.

Milestone Rewards Terms Applicable to US Program Members who Have a Choice Privileges Mastercard (Only)

The Choice Privileges Mastercard is available through a U.S. financial institution and is subject to its own eligibility requirements, which Choice does not control. Unless otherwise specified, the Choice Privileges Mastercard is only available to with a U.S. Choice Privileges account.

Similar to the accelerated path to Elite Status that Members that have a linked Choice Privileges Mastercard enjoy, U.S. Program Members with a linked Choice Privileges Mastercard have an accelerated path to earning Milestone Rewards. In addition to earning Milestone Rewards based on the number of MQCs a Member has earned from Stay Base Points earned from Points-Eligible Stays, Members with a linked Choice Privileges Mastercard also earn MQCs equal to the points earned on qualifying card spend within a calendar year. Note that unless otherwise specified, limited-time cardholder offers (such as any sign-on bonuses), and cardholder anniversary bonuses also do not count toward MQCs; the only way to earn MQCs is through completing Points-Eligible Stays or completing qualified spend on a Choice Privileges Mastercard.

Claiming a Milestone Reward

When a Member earns enough to achieve a specific Milestone Reward, they will see the appropriate Milestone Reward available in their Member Account on ChoiceHotels.com or via the Choice Hotels Mobile App.

Once a Milestone Reward is in the Member’s account, the Member must actively claim the Milestone Reward. “Claiming” is the process of accepting the reward, and, if multiple options are available, choosing which option they would like to receive for that specific Milestone Reward.

In most cases, when a Member earns a Milestone Reward, they will receive the option to receive either a fixed number of points or a Gift Card in a set denomination. For some Members or for some regions, these options may be reduced or expanded. Choice may change the options or values of these reward options at any time without notice.

Each Milestone Reward issued will have a Milestone Reward Claim-By Date which indicates when the Reward must be claimed by. If a Milestone Reward is not claimed by its Claim-By Date, instead of getting to choose their own Milestone Reward option, the Member will automatically earn the points option for that specific Milestone Reward. Unless otherwise stated, this Milestone Claim-By Date is six (6) calendar months after it has been rewarded.

Milestone Rewards Points Option

For each level of Milestone Reward earned, a Member can elect to receive a set number of points as listed. Points will be delivered to the Member’s account shortly after the Member claims the Milestone Reward and selects the points option (or the Claim-By date is reached and the Member receives points as the default option).

Awarding of these points counts as a Qualifying Activity and will push back a Member’s point expiration date (see Point Expiration).

Milestone Rewards Gift Card Option

For each level of Milestone Reward earned, Members in the U.S. and Canada may elect to receive a Gift Card of a specified denomination. This option is only available in regions where Members can redeem their points for Gift Cards (see Redeeming Points).

Unless otherwise specified, the delivery of this Gift Card will mirror the experience of redeeming points for a Gift Card. Members may receive only digital Gift Cards as a Milestone Reward.

The number of airline miles earned varies per airline frequent flyer program and are subject to change. In addition, airline frequent flyer programs may enter and leave the Program with or without notice at any time.

Members can earn six hundred (600) Qantas Frequent Flyer points or six hundred (600) Velocity Frequent Flyer points for every qualifying stay at any Choice hotel in the U.S., Canada, Europe (excluding Denmark, Estonia, Finland, Iceland, Latvia, Lithuania, Norway and Sweden), the Middle East, Mexico, Central America, the Caribbean and Asia-Pac. Velocity Frequent Flyer points are not earned on conference costs or tours and packages purchased via your room account. Velocity Frequent Flyer points are also not earned on purchases from retail outlets.

You can only earn airline miles in one airline program per qualifying stay.

Airline miles can only be earned by one Member per room per stay.

A "stay" is defined as any number of consecutive nights at one hotel regardless of check-ins or check-outs.

You must ensure payment for the room and occupy the room to receive airline miles.

If your individual hotel bill is billed directly to a company and you are responsible for authorization for settlement at check-out, your stay is eligible for airline miles. However, group master-billing arrangements where charges for multiple rooms are placed on one hotel bill and billed to a company or common address or settled at check-out by one individual are not eligible.

Allow two (2) to six (6) weeks after checkout for airline miles to be credited to your frequent flyer account.

Once airline miles have been credited to your designated frequent flyer account, they cannot be moved to another participating frequent flyer program or be moved back to your Choice Privileges account.

Each frequent flyer program has its own terms and conditions, which the Program does not control. These terms may change at any time with or without notice, so you should consult the individual frequent flyer program for the most recent information. Other Terms and Conditions

You agree that Choice has the sole discretion to interpret all Program Rules, and you hereby agree by your participation in the Program to abide by Choice's interpretations.

Any aspect of the Program and/or point rewarding or redeeming is void where prohibited by law.

Program is Subject to Change

The Program is subject to change. Choice may add, change or delete any Program Rule or Program benefit or option in its sole discretion, with or without notice, and may terminate the Program at any time without notice.

Most Choice hotels are independently owned and operated and, as such, participation in the Program and/or parts of the Program may vary. Some hotels offered on the Choice platform may be non-Choice brand hotels and again, their participation in the Program may vary. Always check with your hotel if you have any questions about whether it participates.

If the Choice Privileges Rewards Program is terminated, Members will have up to twelve (12) months from the date that termination of the Program is announced (the “Redemption Period”) to redeem active points for a Choice Privileges reward. The Redemption Period does not extend the expiration date of any points that are expired during the Redemption Period in accordance with the expiration policy.

Member Record Changes

You are responsible for advising Choice through the Choice Service Center of any name change. You must provide Choice with any government/state issued photo ID, such as a driver's license, including your signature, as well as your Choice Privileges Member Number, plus the date of your request, for name change requests. The requirements for a name change are either: (a) an old and new ID respectively showing the old and new names; (b) a marriage or divorce decree showing the old and new name; or (c) an official court document showing the old and new name. A single ID showing only your old or new name does not suffice and will be rejected.

You are responsible for advising Choice through your Online Account or the Choice Service Center of any changes in your contact information including address, phone number or email address to ensure shipment of your reward to the accurate address.

Member Communications

As a Member you may receive email newsletters describing special Program news, promotions, partner offers and benefits.

Choice and its partners are not responsible for delayed, lost or misdirected mail or other correspondence.

If you do not earn points during three (3) consecutive months, Choice may remove you from the Program's active mailing list.

Partner Programs

The Program offers services, products, and other benefits through a number of partners. The Program is not responsible for partner changes to their programs or offerings which may impact the Program.

Corporate IDs

Choice may add or delete a corporate ID in a Member’s account with or without notice as needed.

Member Responsibilities and Violations

You are responsible for understanding the Program rules, tracking your points, and maintaining the security of your account. If the security of your account is breached, Choice is not liable for any access that is not authorized or any account activity that occurs, and Choice is not responsible to reimburse Member for any points redeemed or other damages. If Member becomes aware of any fraudulent activity, they must report it to Choice Privileges within sixty (60) days of it occurring and provide any requested information and cooperation for Choice to consider, in its sole discretion, any reinstatement or adjustment.

You may only maintain one Program Account. If you open more than one Program Account and have more than one Member Number, Choice will credit points to only one account and terminate the other.

Any fraudulent enrollment or other fraud, abuse or violations of Program Rules or benefits, or violation of any federal state or local law, may result in the suspension or termination of the Member’s Choice Privileges account, voidance or expiration of any awarded points, airline miles, the rescindment of any rewards night(s), and/or any other rewards accrued or issued at any time, at the Member’s loss, and Choice reserves the right to pursue legal action.

Choice may, in its sole discretion, revoke your Membership and points if you do not pay outstanding Choice brand hotel accounts in full when they are due or you otherwise do not follow Program rules.

You may not sell or barter points.

Points Policies

Choice Privileges points in a Member's account do not constitute property of the Member. Points have no fixed value, are non-transferable, and are not redeemable for cash or any other form of credit. Points have no value until presented by the Member for redemption in accordance with these Terms and Conditions.

Choice may change the points listed in your Program account based on actual stay information.

You can review your points activity on your Choice Privileges Online Statement.

ARBITRATION AGREEMENT WITH CLASS ACTION AND JURY TRIAL WAIVER (“CLAUSE”)

Arbitration. You and we agree to resolve all Claims by arbitration with a single arbitrator as set forth in this Clause. Each arbitration, including the selection of the arbitrator, will be administered by the American Arbitration Association (“AAA”) (the “Arbitration Administrator”), according to the rules in this Clause and the procedures of the AAA, including, if applicable, its Mass Arbitration Supplementary Rules. The rules of this Clause will govern if there is any contradiction with the AAA procedures. Requests for a copy of the AAA procedures and any question about the AAA must be sent to: American Arbitration Association, 1633 Broadway 10th Floor, New York, NY 10019. You may also visit it online at www.adr.org. If the AAA is unavailable, and you and we can’t agree on a replacement, then you or we may ask a court with jurisdiction to select the substitute arbitration administrator.  Counsel initiating an arbitration shall certify that each demand for arbitration complies with the requirements of Federal Rule of Civil Procedure 11(b) and that the party has complied with pre-arbitration requirements set forth below.

Covered Persons. This Clause governs you, the person(s) opening the account, and us. As used in this Clause, the words “we,” “us,” and “our” mean: (1) Choice; (2) its parents, subsidiaries, affiliates, assignees and successors; (3) the employees, directors, officers, shareholders, members and representatives of these companies; and (4) any person or company that you name in a Claim at the same time you pursue a Claim against us.

Covered Claims. “Claim(s)” shall include all disputes between you and us that a court would normally decide arising out of or relating to the Program, the Rules, your reservation or stay at any Choice-affiliated hotel, Choice or third-party marketing activities, or Choice’s Privacy Policy. “Claim(s)” has the broadest reasonable meaning and includes any request for money damages, injunctive relief, or declaratory relief, whether based on contract, tort, constitution, statute, regulation, ordinance, common law, equity, or otherwise. “Claim(s)” includes disputes arising out of or related to the interpretation or application of the Clause, including its enforceability, revocability, scope, or validity.  An arbitrator, not a court, will decide these matters.

The term “Claim(s)” does not include:

i) any claim for public injunctive relief under California law. In any action including a claim for public injunctive relief under California law, whether such a claim is correctly one for public injunctive relief or private injunctive relief shall be determined by a court and any adjudication of a claim for public injunctive relief shall be determined by a court, but any request seeking monetary relief shall be arbitrated. In such cases the parties agree and will request that the court stay the request for public injunctive relief until the arbitration award pertaining to the individual monetary relief has been determined by an arbitrator and entered in court.  In no event will an action for public injunctive relief be arbitrated; this provision will be deemed null and void in the event California law and/or federal law preempting California law changes to permit the waiver of a public injunctive relief claim in an arbitration provision; or,

ii) any individual action brought by you or us in small claims court or a state’s equivalent court, unless such action is transferred, removed or appealed to a different court, in which case either party may elect arbitration.

Pre-Arbitration or Lawsuit Requirements. Before starting an arbitration or lawsuit, the party seeking to commence a proceeding (the “Claimant”) must give the other party (the “Respondent”) written notice of the Claim (a “Claim Notice”). Claim Notice sent to us must be provided to us at the Notice Address. We may send a Claim Notice to you at any address we have for you in our records. The Claim Notice must explain in reasonable detail the nature of the Claim and include any supporting facts, the requested relief, the Claimant’s address and phone number, and the Claimant must sign it.

The Claimant and Respondent must try to resolve the Claim on an individual basis and without filing an arbitration or lawsuit for at least 30 days (the “Pre-Filing Period”). During the Pre-Filing Period, either party may request that the parties participate personally in a meeting (a “Meet-and-Confer”) which may occur in person, online or by conference call to attempt in good faith to resolve the Claim. The Meet-and-Confer is limited to Claims between you and us. If you are represented by counsel, your counsel may also participate in the Meet-and-Confer. We may participate through any of our representatives.

The Claimant may not start an arbitration or lawsuit until the Claimant complies in full with this requirement. The Claim Notice shall not apply to Claims that are asserted only as counterclaims or that are asserted by the Respondent after it has received a Claim Notice. The statute of limitations for any Claim will be tolled for 60 days following service of a proper Claim Notice.

Lawsuit. The Claimant may bring a lawsuit if the Respondent does not demand arbitration. A demand for arbitration may be given after a lawsuit is filed and may be given in papers or motions filed in the lawsuit.

Federal Arbitration Act. The parties agree and acknowledge that the Program evidences a transaction involving interstate commerce and, therefore, the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq. (“FAA”) shall govern the interpretation and enforcement of this Clause and related proceedings. The arbitrator must apply substantive law and comply with the FAA and honor statutes of limitation and privilege rights.

Arbitration Fees and Decisions. Unless it would conflict with law or make this Clause invalid:

The AAA will decide each party’s share of arbitration fees and costs for arbitration based on the law and its rules.

A party is entitled to recover its reasonable attorney fees and costs, arbitrator compensation, and AAA administrative fees if the other party brings or defends a Claim for purposes of harassment or that is frivolous.

The parties agree that the provisions of Federal Rule of Civil Procedure 68 shall apply to any Claim and be enforced by the arbitrator.

Mass Filing. If a Claim is part of a “Mass Arbitration” under the AAA’s Mass Arbitration Supplementary Rules, the parties agree that these additional procedures shall apply. The parties further acknowledge that electing to be part of a Mass Arbitration may delay the adjudication of a claim.  If claims qualify as a Mass Arbitration, counsel for the parties shall each select 10 demands from each side (20 demands total) to proceed in individual arbitrations (“Stage One”). After Stage One is complete, the parties shall promptly engage in a global mediation.  If the remaining demands are not resolved after the global mediation, counsel for each side shall select 50 demands (100 demands total) to proceed in individual arbitrations (“Stage Two”). After Stage Two is complete, the parties shall promptly engage in a second global mediation regarding the remaining demands.  If the remaining demands are not resolved, the AAA shall administer the remaining demands in concurrent batches of 50 demands, with each batch assigned to one arbitrator, who shall conduct individual arbitrations.

Appeals. Except for: (a) Federal Arbitration Act appeal rights; and (b) Claims involving more than $50,000 (including Claims for an order that could cost more than $50,000), the arbitrator’s award will be final and binding. For Claims involving more than $50,000, either party may appeal the award to a three-person panel selected per this Clause. The panel will revisit from the start any part of the initial award either party has appealed. The panel's decision will be final and binding except for any FAA appeal right. Any appropriate court may enter judgment upon the arbitrator’s (or panel’s) award.

Class Action Waiver and Jury Trial Waiver. If you start an arbitration or we demand arbitration, YOU GIVE UP YOUR RIGHT TO: (A) HAVE A COURT OR JURY DECIDE THE CLAIM; (B) BRING THE CLAIM AS A PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE OF OTHER PARTIES; (C) WITHOUT OUR CONSENT, JOIN THE CLAIM WITH CLAIMS OF OTHER CONSUMERS; OR (D) ENGAGE IN A CLASS ACTION OR CLASS ARBITRATION.

Opt Out. If you do not want this Clause to apply, you must send us a signed written notice, which includes your account number, stating that you opt out of this Clause. The notice must be sent within 30 calendar days of the later of the date you open your account or the date that this Clause is made available to you. You must send the notice in writing to us at [insert address] (or any address we later provide you to opt out of this Clause) (the “Notice Address”).

Severability and Survival. If any part of this Clause, other than the Class Action Waiver, is deemed or found to be unenforceable for any reason, the remainder shall be enforceable. This Clause shall survive the termination of the termination of any relationship between us.  It will also survive any bankruptcy to the extent consistent with applicable bankruptcy law.
